ArboristDave provides an AI-powered call handling and lead management platform ("DaveBot") designed to assist tree care businesses in capturing and responding to inbound customer inquiries. Services include but are not limited to automated call answering, appointment scheduling, lead capture, and CRM integrations.

2. Eligibility

By using our services, you represent that you are at least 18 years of age and have the legal authority to enter into this agreement on behalf of yourself or your business.

3. AI-Powered Service Disclaimer

DaveBot is an artificial intelligence assistant. While we strive for accuracy, AI responses may not always be perfect. ArboristDave and Best Response Marketing Agency are not liable for any errors, omissions, or outcomes resulting from AI-generated responses. Human oversight is recommended for all critical business decisions.

4. Subscriptions & Payment

  • Access to DaveBot and associated services may require a paid subscription.
  • Subscription fees are billed on the schedule agreed upon at sign-up (monthly or annually).
  • All fees are non-refundable unless otherwise stated in a separate agreement.
  • We reserve the right to modify pricing with 30 days' written notice.

5. Call Recording & Consent

By using our call handling service, you acknowledge and agree that calls may be recorded and processed by AI systems for service delivery, quality assurance, and training purposes. It is your responsibility as a business operator to ensure your customers are properly notified of call recording in compliance with applicable state and federal laws, including Pennsylvania's wiretapping statutes.

6. Prohibited Use

You agree not to use our services to:

  • Violate any applicable local, state, or federal laws or regulations.
  • Engage in spam, harassment, or unsolicited communications.
  • Attempt to reverse-engineer, copy, or replicate our AI technology.
  • Interfere with or disrupt the operation of our platform.

7. Intellectual Property

All content, technology, branding, and materials on arboristdave.ai are the exclusive property of Best Response Marketing Agency and its licensors. You may not reproduce, distribute, or create derivative works without prior written consent.

8. Limitation of Liability

To the fullest extent permitted by law, ArboristDave and Best Response Marketing Agency shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our services, including but not limited to lost revenue, missed leads, or data loss.
